Terms of Service

These terms govern your account, your content, PostWell-generated ideas, subscriptions, acceptable use, and the responsibilities that come with publishing.

The important version

You keep your rights in the brand material and content you provide. You must have permission to use what you upload, review generated work before publishing it, and use PostWell lawfully. AI output can be wrong or non-unique. Paid subscriptions renew until canceled according to the billing interval selected at checkout.

1. Agreement and eligibility

These Terms form an agreement between you and the operator of PostWell (“PostWell,” “we,” or “us”) and govern use of usepostwell.com and the related application, generation, rendering, storage, support, and billing features (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

You must be legally able to enter this agreement. If you use PostWell for a business or organization, you confirm that you have authority to bind it and that “you” includes that organization.

2. The Service

PostWell learns from brand information you confirm and provides content ideas, meme and UGC Story feeds, UGC discovery, editing, rendering, storage, downloads, and related tools. Features may vary by plan or change as the product develops. Preview, beta, or test features may be modified or withdrawn.

PostWell does not currently promise social-platform publishing, guaranteed reach, engagement, revenue, originality, legal clearance, or any particular marketing result.

3. Accounts and workspaces

  • Provide accurate information and keep credentials secure.
  • Do not share a personal login or let an unauthorized person use your account.
  • You are responsible for workspace members, their permissions, and activity performed through your account.
  • Tell us promptly through Help & feedback if you suspect unauthorized access.

We may limit, suspend, or terminate access when reasonably necessary to protect the Service, investigate misuse, comply with law, or enforce these Terms.

4. Plans, usage, and billing

The free sample includes the ideas and limits shown on the pricing page and is limited to one sample per person, business, and device. Creating additional accounts, clearing browser data, changing email addresses, or otherwise attempting to reset the free allowance does not create another entitlement. We may use proportionate account, device, network, and business-domain signals to enforce this limit and may require a paid plan when a previous free sample is detected. Contact Help & feedback if you believe a restriction is mistaken.

Paid plans, billing intervals, workspace allowances, and generation limits are shown before purchase. Reaching a usage limit pauses new generation; it does not remove saved ideas, editing, completed renders, or downloads that remain otherwise available.

Paid subscriptions are processed by Stripe and renew for the billing interval selected at checkout until canceled. Taxes may apply. You may cancel through the billing portal, with cancellation normally effective at the end of the current paid period. Except where required by law or expressly stated during checkout, charges are non-refundable. Failed or reversed payments may suspend paid features.

Prices and plan features may change for future billing periods with reasonable notice.

5. Your content and permissions

You retain ownership of brand information, prompts, uploads, captions, and other material you provide (“Your Content”). You grant PostWell a limited, worldwide license to host, copy, process, transform, and display Your Content only as needed to provide, secure, support, and improve the Service.

You represent that you have all rights, permissions, consents, releases, and lawful authority needed for every website, brand, logo, image, video, audio file, likeness, and other item you provide or direct PostWell to process. Do not submit confidential, sensitive, or regulated information unless it is necessary, lawful, and appropriate for the Service.

6. Generated output and UGC assets

As between you and PostWell, and to the extent PostWell has rights it can grant, you may use output generated specifically for your workspace. AI output may be inaccurate, biased, incomplete, non-unique, unsuitable, or similar to other content. You are solely responsible for reviewing, editing, fact-checking, clearing, and approving output before use.

UGC footage and other catalog assets may be subject to source-specific rights, licenses, or restrictions. Access to an asset does not transfer ownership of the underlying source. Use catalog media only through the rights and workflows PostWell makes available, and do not extract, redistribute, resell, or build a separate media library from source assets.

You are responsible for disclosures, permissions, advertising standards, platform rules, intellectual-property rights, privacy and publicity rights, and other requirements that apply when you publish or commercialize content.

7. Acceptable use

You may not use the Service to:

  • Break the law, infringe rights, deceive people, defame or harass others, or create unlawful or non-consensual content.
  • Impersonate a real person or organization without authority, or create deceptive synthetic media.
  • Upload malware, attack the Service, bypass access controls, probe vulnerabilities without permission, or interfere with other users.
  • Scrape, bulk-download, copy, mirror, reverse engineer, or extract source media, models, prompts, code, or datasets except where law expressly permits it.
  • Use bots or automated access outside an interface or API we expressly authorize.
  • Resell access, share credentials, evade plan limits, or use PostWell to build or benchmark a competing service without written permission.
  • Use content involving protected classes, health, finance, politics, adult material, gambling, or other sensitive areas in a misleading, harmful, or unlawful way.

8. PostWell intellectual property

PostWell and its licensors retain rights in the Service, software, interface, brand, documentation, workflows, catalog organization, and technology. These Terms grant only a limited, non-exclusive, non-transferable, revocable right to use the Service during your account term. Feedback may be used without restriction or compensation, but we will not publicly identify you as its source without permission.

9. Third-party services

The Service relies on third parties for authentication, hosting, storage, AI processing, rendering, analytics, billing, and linked media sources. Their services and terms may affect availability or use. PostWell is not responsible for third-party platforms, their policies, outages, moderation decisions, account restrictions, or changes.

10. Privacy and security

Our Privacy Policy explains how information is handled. You must use reasonable safeguards for accounts and personal information. Although we use reasonable security measures, no online service can guarantee absolute security or uninterrupted availability.

11. Service availability and changes

We aim to keep PostWell useful and available, but the Service is provided on an “as available” basis. Generation and rendering may queue, fail, or vary. We may maintain, update, rate-limit, or change features to improve quality, security, compliance, or reliability. We do not promise a service-level agreement unless a separate written agreement says otherwise.

12. Disclaimers

To the maximum extent permitted by law, the Service and all output are provided “as is” and “as available,” without warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or marketing performance. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, PostWell will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, goodwill, opportunities, or data; publishing decisions; third-party claims; or platform restrictions arising from use of the Service. Where liability cannot be excluded, PostWell’s aggregate liability relating to the Service will not exceed the greater of the amount you paid PostWell in the twelve months before the event giving rise to the claim or USD $100.

Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.

14. Indemnity

To the extent permitted by law, you will defend and indemnify PostWell and its personnel against third-party claims, losses, and reasonable costs arising from Your Content, your publication or use of output, your breach of these Terms, or your violation of law or another person’s rights.

15. Termination

You may stop using PostWell at any time and may request account deletion from Settings. We may suspend or terminate access for material or repeated breach, security risk, unlawful activity, non-payment, or where continued operation is no longer reasonably possible. Provisions that by nature should survive—including ownership, payment obligations, disclaimers, liability limits, and dispute terms—continue after termination.

16. Changes and general terms

We may update these Terms as the Service or applicable requirements change. Material changes will be posted with an updated date and, when appropriate, additional notice. Continued use after an effective change means you accept the revised Terms.

If part of these Terms is unenforceable, the rest remains effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without consent; PostWell may assign them as part of a financing, reorganization, merger, acquisition, or sale. Applicable mandatory consumer and local laws remain in effect.

17. Contact and disputes

Please raise questions or disputes through Help & feedback inside PostWell or by replying to an account or support message. Before filing a formal claim, both sides agree to try in good faith to resolve the issue informally for at least 30 days, unless urgent relief or applicable law requires otherwise.
